SUN BLINDS
A CHRISTCHURCH CASE. CHRISTCHURCH, dan. 15. Reserved judgment has been delivered by .Mr 11. A. Young. S.M., in the cm- 1 in which Miss Margaret Isherwoed. carrying on business in. Colombo street, City, as a fruiterer and a confectioner, was charged (in December last) by the Chief City Inspector with having hung a sun-blind out over the footpath without- the Council’s permission.
When the ease was heard, counsel for Miss Ishcrwood (Mr W R. La.seellcs) contended that the by-law under which lu's client was charged was unreasonable. The defendant earned on business on the cast side ot Colombo street in an hotel building, and about a year ago the post verandah of front of flic shop was condemned by the Citv authorities as lining dangeron,; t;, the public, and was removed. A post verandah to take its place would not he permitted, and the hotel promises would not. lie strong enough to hear the weight of a suspended verandah. Therefore, in order to protect her goods, she had erected a continental hooded window shade over the public footway without permission. It had been argued, his Worship said, that the section was unreasonable because it- allowed the Council jo refuse a reasonable request for permission. However, in his opinion, the discretion allowed to the Council was not so great as to he unreasonable. Defendant would he convicted and fined Is and eosts.
