At the nolice court, Harry Jeffery, charged with receiving £ll for art union books given him to sell, and failing to account for same, pleaded guilty and was remanded for sentence. Gordon Douglas Inkster, already on probation for theft at. Auckland, was before the police court charged with theft of numerous articles, including 25 pairs of silk stockings, of a total value of £5 from a drapery firm lowborn lie was employed at Gisborne. He pleaded guilty and was sentenced to two veals' reformative detention.

WRESTLING. AUCKLAND. October 13. Walter Miller, the world's champion, middle-weight wrestler, made his first appearanee at the Town Hall to-night. He threw M. Brown in the first bout, t fins winning his ehnllenge to throw any local wrestler in three ten-minute bouts. Miller also appeared in an exhibition bout with T. College. A match lias been arranged between Miller and Jawahla.

CONCRETE OR BITUMEN? AX AUCKLAND ROAD. AUCKLAND. Oet. 13. The competition between concrete and bitumen for road-making is becoming brisk. So far most Auckland local bodies have favoured concrete,, while in Taranaki and Wellington bitumen seems to have won the day. A new development has just taken place in regard to the stirhurhnn section of tlte Great South Road. The local bodies favoured concrete, but the- Alain Highways Board demurred on account of the high cost, and suggested surfacing with bituminus concrete. The cost per mile of bituminus concrete as required by the Highways Board is estimated at hetween £9OOO
and CIO.OOO. The cost, of a permanent concrete road is estimated at between £IO,OOO and £II,OOO per mile. At a meeting of the local bodies interested an offer was made by the Wilson (New Zealand) Portland C'eincut Company to lindcrtiikc to coilstruct, the road for the distance stipulated and in accordance with the plans at a cost of between £BO9O and £9OOO per mile.
This is cheaper than the other method, and has the advantage that the material used is a local production, whereas all bitumen has to he imported. The local bodies concerned. after considering the offer made. iinaiiimoiiFly decided to ask the Highways Board to approve of the proposal, and also to contribute 50 per cent, of the cost.
ROAD CASK APPEAL. WELLINGTON. October 15
At tlio Court of Appeal this morning judgmeitl was given in the case of the Palniorsion North Borough Council v. Casey, which was heard on the 19lh July. .Mr Justice Sim in delivering judgment said he considered it clear that the Council was not justified in imposing tlie conditions which it sought to impose, viz., the tarring and sanding of newly formed streets. The Council was entitled under section 110 of the .Municipal Corporations Act to insist on mailing being formed and metalled to its satisfaction. hut was not entitled lo in.-ist on the roadway being tarred or sanded, since such work was not part of the formation. Sir Robert Stout dissented on the ground that the Corporation had the right to demand the tarring and sanding of the footpath and in the rase of the road law as to subdivision uf laud not having been followed, (la* Council was entitled to have the tarring and sanding done. The other Judges concurred with Mr Justice Sims' judgment and the appeal was dismissed.
