NEW YORK, duly Id. The trial of Scopes at Dayton is praeI irallv over so far as the County Court is concerned. The presiding Judge declared in it lengthy statenicnl that the Tcniiesse law prohibiting tin' teaching of evolution is a constitutional alienee which admits 1 Suit Scopes violated this law; therefore it remains only for the jury to he inslmeted to return a verdict of guilty. A light, upon the constitutional law will he made in an appeal to a Higher Court. It is probable, however, that before the trial actually ends thenwill lie many speeches delivered and possibly expert testimony will be taken.
