July last, and the subsequent refusal of the underwriters to reimburse the ownarc to the extent of £20.70 for which the vessel was insured against absolute total loss, was the basis of an action ciiamienced at the Supreme Court to-day.

The owner of the ship was Lionel (.cargo Clare, with whom the National Bank joined as plaintiff. The defendants were the Canton Insurance ('ompany. Plaintiff contended that llte vessel

was a total loss; therefore they wore entitled to reennier the insurance. The defence alleges, firstly that the vessel was not properly equipped as required under the terms o( the policy, and secondly, that the vo-.-el was not an absolute total loss.
