An interesting reserved judgment was given on Saturday at Gtcymouth I,v Justice- .MacGregor in a case where tiie police appealed, against Magistrate Meidruin’s dismissal of a charge against Charlotte Denis, licensee of a Kiimara hotel for lot using accommodation to F. King, a prohibition lecturer. Justice MacGregor said that no valid reason was given for refusing accou modatioii, and the real reason seemed to he the fact that King was

prohibition agent. That was not valid reason in law. however distasteful the supplying of such accommodation was to the licensee. King was a member of the travelling public and the licensee was bound to supply lodging for the night. It. was dear r. |,rea< hol the law was made and the licensee should have been convicted, file* Judge expressed surprise that the Magistrate had not convicted, as it was difficult to imagine a clearer case of a refusal. The case was remitted back to the lower Court. Costs of the appeal, £lO, were allowed the police.

At Wellington last, night an official „f the Main Highways Hoard questioned concerning the alleged dissatisfaction anions boroughs and towns with tlu*Act, on the ground that it nflords them no ’benefit exiept where their roads have been declared main liignvays. replied that the Alain Highways Act gave power to tlie Uiaril to subsidise the cost of maintenance of streets which were a continuation of main highways on tfie same basis as it i oiitriimteil towards the cost of maintenance ol adjoining countv roads. If a street in a borougu ’costs £2OO per year to maintain, but the adjoining highway costs only £l5O. tin* bumfs contribution to the borough will he one-third oi £l5O. During the earlier part of 1024 the board approved of certain boroughs in the Dominion obtaining the benefit of that portion ot the Act, but towards the end of the last financial year, the board was compelled to decline further applications until its financial position could be defined. It is understood, however, that the board proposed to reconsider tins point shortly. Borough C ouncils are admittedlv dissatisfied because they receive no benefit unless lhe road through the borough has been declared a main highway, but only in one or two exceptional cases have roads through boroughs been so declared. In reply to a further question, the official said that apparentlv boroughs contended that as most of tlie motor vehicles were to be louml in the towns they were thus contributing to the funds of the Alain Highways Board.
