AIIDLAND BANK CASE. ROBINSON'S APPEAL DISMISSED. LONDON, March 20. In giving the Appeal Court’s reasons for dismissing the. appeal liy Robinson in the Midland Bank case, the Master of the Rolls, said the aide-de-camp. Robins and Newton, were, parties to the conspiracy to catch Sir Huri Singh with Mrs Robinson. Tt was clear the conspirators never intend;;! to pay the money to plaintiff. 'They used the name of Charles Robinson for convenience, hut it was a mere cypher and title for an account. Judgment would lie varied by allowing the plaintiff costs, due to his having proved that lie was not a party to the conspiracy; but these would he set t.ff against the costs on the other issues on which he was liable to the Bank.
Lord Justice Atkin said the only evidence connecting plaintiff with the conspiracy was the evidence of Newton, who was a convicted forger, a self-confessed blackmailer, and an accomplice to the conspiracy, and who was paid £3OOO for giving evidence. The jury was entitled to reject Newton’s evidence. The authorities had apparently given Newton immunity from criminal proceedings and the result was distinctly encouraging for Newton’s infraction ol the- criminal law of the country.
