A point of interest to land agents and vendors of property was decided by Mr .Justice MacGregor in the Wellington Supreme Court last week. The rase was an appeal by Samuel Charles -Alayall against the decision of Mr NY. G. Riddell 5..A1., awarding judgment for commission in favour of Montrose Irwin Mitehinson. land agent. His Honour said that the sole question was whether the document upon which Mitehinson relied in this ease contained a recognition by the vendor that the agent was acting for him in the transaction. It was signed by the* intending purchaser and addressed to “Mr M. J. Alitchinson, land agent, NYellington.” The land agent had then taken or forwarded it to the appellant, who had endorsed it. “ Accepted, C. M.ayall.” In so accepting the offer, Afoyall had adopted the whole document, including the fact that it was made between the intending purchaser and an agent who was endeavouring to sell it on his behalf us owner. This, His Honour held, was an admission or acknowledgment by Alayall that Alitehinson was acting as liis agent in the transaction. The appeal was accordingly dismissed, with costs L'7 .s. Mr S. A. AYiren appeared for appellant, and Mr C. Mazengarb for Mitehinson.
