THEFT OF TOBACCO. AUCKLAND, November 18,
Thieves entered the warehouse of Hutchinson Pros., Ltd., A tissue Avenue, during the week-end, stealing £HSA worth of tobacco and cigarettes. Untry was effected by breaking a window on the ground lloor.

At the Police Court, Frederick Henry Rowley, aged -11, on nine charges of theft involving CM and on nine charges of unlawfully assuming the designation of detective received two years reformative detention. DAMAGES AWARDED. At the Supreme Court, Clinie .Tames Drike, a farmer of Waorangi, was awarded. Cool damages against Harry White Gretwell and Thomas .Malcolm Grctwell, for a cowardly and brutal assault on the Te Kaiwahata road on August- 21, ini’ll, for which the accused have now served .sentences of three years imprisonment on llie Waikcria prison farm.

A deputation waited on the Toiigariro Park Hoard and protested strongly against the site chosen for the hostel and the introduction of heather and grouse. The site favoured was Wliakapnpn. The Chairman considered too much was made of the point. The .Park would become a shooting reserve that was not intended. The Minister of Lands opposed the contention that heather would interfere with the growch of forest trees. Later on Mr Salt gave notice to rescind the resolution in favour of the Haunted Wliare site for the hostel. The motion that the Park be regarded as an absolute sanctuary for New Zealand flora and fauna was lost by six to live and Hie amendment, on the casting vote of the Chairman, that nothing should lie introduced into the Park without resolution by the Hoard. Tt was stated the Hoard still requested further contributions from local bodies and societies in provide the hostel etc. There are now motor roads to within half a mile of the Haunted Wliare and two hot baths at Whaknpnpn. Smart. •Ltd., against Chandler and Co. T.td. lMaintilf’s counsel said that it was a lie-red that the contract was made l.y a representative of the defendant company in the capacity of ape,it. when he had no such authority to act as an a pent, and at a time when the defendan company, moreover, hnew that it? representative. Air Parr, had no iuithoritv to act as agent. The' defence said that there was no contract and that the orders were giyon subject to the approval of the municipal authorities. Air Parr expressly told Air Smart that, the Wellington order was subject to approval. John Parr pave evidence that he had no conversations with Smart regarding the powers of mimciipal bodies throughout New Zealand coueoi ninp tramcar advertisinp. His Honour said that if the jury found that Parr told Smart the advertisinp had t» he approved by the municipal authorities the whole of plaintiff’s ease fell to the ground. _ After a short, retirement, tlie jury returned a verdict for the defendant company.
