Sorgt.-Major Joldon stated since the issue of the .summons, * defendant who was now at Auckland, had applied for a transfer. Convicted and fined 10s and costs ,s. LICENSING ACT. Charges of being found unlawfully on licensed premises alter hoius weic dealt with as iol!o«s; Two men (Central Hotel) convicted and ordeted to pay costs 7s. each. One man (Ail Nations Hotel. Riinu) (Mr Wells). Convicted and ordered to pay vests 7s. WANDERING CATTLE. Police v. F. Preston, allowing two houses to wander. Fined 20s and costs Same v. W. Jelfries (Mr Pilkingtou) 2 ponies. Fined 10s and costs is. HEAVY TRAFFIC BYE-LAW. Public Works Department- (Mr Dark) v. William and George Searle, a charge of using the south road near Mikonui on July Ist and 2nd for a motor loriy for which no license had been obtained. Defendants pleaded not guilty. Mr Park said this was a prosecution under the same bye-law that -Mr Sea lie had been prosecuted under previously. Mr Searle had promised on the previous ijcctisioii not to use the lorry on the road, but he had tailed to keep his promise. James I). Gillies, Di.-tiiet Engineer of the Public Works Department stated that Mr Searle had written admitting lisino the bury on the two occasions, and asking that the information he withdrawn. He lmd mi license lor the luiry. He had asked for the license IV,> to he reduced, but witness had no power to do so. On a previous occasion .Mr Searle lmd promised not to use the lorry again on the roads, but he had not kept that promise. John Mitchell, road foreman at Mikonui gave evidence that he saw Searle’s l.cyhmd lorry on the road on July Ist. and 2nd. The lorry would weight J to 4 tons, and loaded between G to i tons. Had seen the lorry on the road on several occasions since the last conviction.
Patrick Fitzgetald, depose! he was in charge of the Government road between Russ and Waiho. .lie had instructed Mitchell to take a tally when the lorry was used on the road. Had seen the bury in March and June and seven other dates were reported to witness. To Mr Searle-Had promised not to put the lony on the road again. ( oulil not say that Mr Searle had added, unless the International (smaller lorry) had broken down.
\\ illiam Searle deposed lie was tbo owner of the Ley land motor lorry. On June JOlli. the International lorry lost its tly wheel. Next day took the Levland to tow the International to Ross look a light load home. That was the oi.lv reason why the hoarder machin was used.
His Worship said the question to be de iiled was that the lorry was used and that was admitted. A conviction was entered and a fine indicted of £o wi„i costs £2 9s on both charges'. CIVIL CASES.
