Tile death of Mr John l’arkhill ot Fitzltcrbort Street, which took place yesterday alternoon about 1.30 o’clock removes another of the old and valued citizens who are so rapidly passing away. The Arbitration Court at Greymoutli on Saturday allowed the appeal of Tyson (Inspector of Awards) against the Magistrate's decision of Feb. 19th. dismissing a charge against local tobacconists of opening their shops on New Year’s Eve, in addition to the ordinary late night in the same week. The Magistrate held that the aliening was permitted by Clause 99 of the Award. .Justice Frazer on Saturday said nothing in the Award could cooperate in contradiction of the Shops and Offices Act. The Court had delegated legislative powers, but could not go contrary to an Act, any more than could a local body in contravention of tb<' Municipal Co-operations Act. In a further ease Tyson also applied for a ruling as to whether the Watersiders' I'nioii in refusing membership to a certain applicant against whom there was no strong evidence of bad character or insobriety, bad lost thereby his right to preference.
