'I ill* Court of Appeal is to-day engaged iu considering a ease removed into the Court of Appeal of McDougall v. the Attorney-General, and ilie permanent bead of the Railway Department. The question for the Court i.s an interpretation of sections 12 and I I of the Public Service Expenditure Adjustment Act. 1921. and of regulations under Section I I. .McDiuigiill. a leading fitter iu the Railway service, contends he lias not been paid the scale increase of salary to which lie is entitled.
A preliminary point was taken by the Attorney-General that the l)c----laratory Judgments Act. 19(18, under which the proceedings were issued •mild not lie involved in any matter ill N.Z.. in which the Crown is to n* bound.
Mr Skerrctt K.O. with him Mir O'Leary, appeared for the plaintiff. Sir I*’. Bell K.C.. for the Attorney General and Mr Myers K.C.. for the Railway Department and with them Mr Fair. The Court dismissed the appeal in the Toognod v. Nash case (July Ist), holding a husband was lint liable for the cost incurred hy tho wife in unsuccessfully bringing or defending divorce proceedings against the husband. \ii application for leave to appeal to the Privy Council, was reserved for consideration. SUGAR REDUCED. AUCKLAND. July 11. A reduction of 311 s per lon in the wholesale price of all grades ol raw and refined sugar is announced hy the Colonial Sugar Refining Coy.
