The deceased's widow said she resided with her hush.ind in looms rented fniui William Keir. When they went home at o.flll p.m. on .Tulle - the Keir family said they could not esitei. Air Keir and deceased had a few words. Keir knocked hej husband down. Deceased g< i up. Then Keir hit him again and ho fell. Ili- head struck the gutter. Constakle Oil deposed he lotind the deceased lyi g on tile footpath and conveyed him to the police station, thence to tile hospital. Witness produced a statement- made by Keir in which he asserts that N'earv was drunk and abused his sister, lie put Wary outside and locked the door. Later N’earv relumed -still drunk. He' wont to prevent Mr and Airs N'earv entering l,v the* window whc’ii Nt'ary struck Txeary away and lie fell into the' gut11iin with a walking stick. He pushed tor. He denied having struck Wary on either occasion.
The Coroner found that death was caused l,v a fracture' of the skull and a laceration of the brain caused by a fall following a blow struck by "William Keir. death being accelerated by aj fall.
Keir subsequently appealed before the Court and was committed for trial on a charge of manslaughter.
