At the Criminal Sessions of the (Supreme Court to-day Air .Justice Stringer reviewed the charge of manslaughter
against John Andrew Fox, arising from the death of a policeman named Todd who. with accused and another man, were returning from a dance to Onehungu when they collided with a Chinaman's cart. His Honour said tin; evidence would show that Fox was driving in a reckless fashion and that the Chinaman’s cart was on its proper side of the road. F.vidcntly they had driven to Pupa burn to get a supply of liquor, returning to Auckland early in the morning. They seemed to have made lieasts of themselves. There would he little dillieulty in establishing a prima facie case against Fox.

Six prisoners appeared before Air Justice Chapman in the Supreme Court to-day for sentence. Leonard Leslie Simmonds, for forgery at Masterten. was sentenced to four months' imprisonment. Owen Richard ITealy, for rape at Palmerston North, said he had nothing to say. Ilis Honor decided to suspend sentence. Henry Juliu.s Kessler, charged with breaking and entering, put in a wiitlen statement. The Judge said that insufficient evidence had been put before the Court to enable him to declare sentence, and the rase would stand over. John Robert Shirley, for theft of goods as a servant, was sentenced to six months’ imprisonment. A lad of fifteen was sentenced to five v,.ills’ reformative treatment for theft. He had been charged on three previous occasions. Charles Aynslev. lor forgery of a telegram arid of a receipt, for a registered letter was sentenced to fourteen days’ imprisonment.

In the Supreme Court Air Justice Stringer gave judgment for the City Council in a case against the ( town claiming the sum ol £2l 8s (id as charge for puli; ’eting and removing refuse, from post otliees in the city. His tumor said the contention that the Crown was nut lioufnl by the provisions of the .Municipal Corporations Act was correct. The ease 11111st be decided apart from the provisions of the Act The crown having availed itself of the facilities offered was under obligation to pay for them at a reasonable sum.
