Greymnuth yesterday. Rachel Annie Matliiesoii. and her husband \\ illinm James Mathieson, (who was alleged to have incited his wife to the deed) weie jointly charged with assaulting Christina Llaimani, Malhiosons’ sister. Mr W j’. McCarthy appeared for the complainant and defendants "erw represented by Mr J. \Y. Hannan. Mr MiCarthv said that the trouble arose from a family dispute. I here was no evidence of actual bodily assault on the part of the husband, hut he aided and abett thi' wife by telling her to strike the complainant and therefore became a party to the assault. After hearing evidence, the Magistrate said the evidence was conflicting and there was a doubt as to who commenced. Complainant had brought a good deal of it upon herself by the statements she had made, a"i| was in fact the aggressor as far as language was concoined. I lie statements that she uttered about the hoy. almost justified Mrs Mathieson s action. H was spiteful and cruel, continued the Magistrate, to h■ fleet thus on the boy. and to that extent, the defendant was justified. Flit !>ai however, gone little too far. She was a strong woman end any fight, between her and the complainant would be oue-sided. She said, herself that she used a great many blows and those were unnecessary.
She was not entitled to use more force than was needed to stop complainant
pulling her hair. Defendant would be convicted: but in view of the eircum-
