A b:>v. Frederick Smith, aged 15, was commuted for trial on a charge ol murdering Constable Delaney at Swan iliil. The evidence diselosetl the Constable went to interview the boy in connection with a robbery. Smith nrdereu Delaney to put his hands up. The constable ’replied : “No fear! Put your hands up!” Smith thereupon lived at Ihe constable. Smith stated he shot (unstable Delaney because lie was frightened that lie intended to question him about the robbery, lie added that Constable Delaney asked him to D'h the people he died bravely.
