The Company pleaded not guilty and maintained that the prosecution was invalid in that the Department failed to supply the Company with a sample of the butter tested. The Magistrate gave judgment l'<-r the Department and said that it was clearly proved that the butter was well in excess of the If', runs of moisture regulated by the Act. Ihe Court was
