A WILL CASE.
AVI DOW SEEKS BETTER PKOVTSIOX. [BY TELEonArn— PER PRESS ASSOCIATION.] WELLINGTON, Juno 20. To-day a caso came 'before the Supreme Court, in which the plaintiff was the widow of a New Plymouth resident, who left u fairly large sum of money for purposes of a. charitable nature, including provision for destitute Chinese and 'lndians, and a small annuity to the wife, who is now an invalid. The petitioer was Mary Catherine Kirkpatrick. An annuity of £l5O was bequeathed do the petitioner. To a nephew deceased had left £-100. 1 o the children of another woman he left £-100 primarily to he applied in fitting a sou for the priesthood. If the son was unsuitable the money was to be expended for the general education ol the other children. To religious charities and trusts deceased left £2,(325. and other sums for Masses. The residue £IBO/, was to go towards assisting destitute Chinese and Indians. It was stated the plaintiff was 50 years of age. and was a permanent invalid, requiring constant attention. A nurse suggested her health had been undermined in attending to her husband during the last ten jvears of his life. She was married to him in 1881. The widow asked for £250 cash, the use of a house occupied by her. and that the annuity he increased to £3OO per annum. Air Cromhie. who appeared for the Roman Catholic Archbishop of Wellington. stated that his client agreed that, owing to altered circumstances since the will was made, further provision should he made to the widow. He suggested that the annuity be raised to £2OO, and that plaintiff should have the use of the house and furniture tor life, or. in lieu of this that she he given an additional amount. His Honour remarked that chant" should begin at home. Jle reserved his decision.
