AT. OKARITO. 1 M’EDNESDAY AND THURSDAY \ DECEMBER- 13th., and 14th. j (Before AV. Aleldrum lisq., g.M.) Norman Friend (Mr l’ilkington) v. James Gilchrist Mcliarry (Mr Afurdoch) a claim for £4B damages and cost arising out of the disputed ownership of a cow. The evidence of plaintiff and the following witnesses—John Collett, Janus S. Friend, Const Drummond, John Adamson, H. Adamson. Joseph Alinchan, AT. Fane. V. Pedrazzi, , and P. O’Connor was heard. ’l’lie Court having opened at 7 p.m. on Wednesday the plaintiff's case concluded at 1 o’clock next morning when the Magistrate asked counsel what

course they preferred to follow as to adjournment. AL Afurdoch (for defendant) announced lie was ready tu proceed with the defendant’s case subject to the reservation that he should he permitted to deal with the legal aspect at Hokitika. This course was eventually agreed to by all parties and tinevidence of tlie defendant, and Norman Karnhach was taken. (All the witnesses were examined and cross examined at- great length, the Court rising at 2 a.in. on Thursday morning when the ea-c was adjourned to Hokitika. SITTING AT HOKITIKA. On Saturday afternoon the -bearing of the case was continued at Hokitika. Air Pilkington addressed the Court in support of the claim for damages, and Afr Alurdocli raised several nonsuit points, both counsel addressing the Court at considerable length. 'Hie Alagistrate in giving judgment held that the plaintiff could not sustain his action on any of the grounds mentioned in his statement of claim, neither for the loss of the cow, the grazing of the animal, nor the general damages The plaintiff would therefore he non-suited with costs amounting to £0 15s. CHAR OK OF ASSAULT. The Police charged John Starkey with assault on n hoy aged 13 years nt AVoodstoek school on 4th. December. After hearing evidence tlie Magistrate said he did not consider the assault a serious one. Defendant was convicted and fined 20s with costs 31s 3d
