Mr Ostler said the defence would call an oceiwhelining body of expert evidence to prove there was no danger of all accumulation of inflammable gas in the
mine. They would not snv there was no possibility for an accumulation of gas. but that there was no likelihood. Counsel said there had been no ignitions. with the exception of those in May 192(1. regarding the amount of which the evidence was vague and unsatisfactory. No one had ever been injured. Since May. 1920. dozens of faults had been cut through, but no trace of gas had been found. Judgment was delivered "by Mr Platts S.M. to-day in a charge against Herbert Hino (Mayor) on ton counts that be noted ns Mayor while concerned or interested in a contract with the Council to the value of C 37 5s 2d. This amount .was owing to him as Borough Solicitor bcfgre lie was elected Mayor. Mr Platts held the defendant was interested and therefore incapable of being elected Mayor or holding office. The Audit Office did not suggest any moral turpitude and defendant was a man of acknowledged integrity, who af considerable sacrifice undertook a pubbe duty at a critical time in the history of the borough. Tt would be sufficient if he was merely convicted, and ordered to pay costs.
