Mr Justice Herd inn n. mid Air Justice Snhiiond, ivns that, of the prisoner, George Kelly, who appealed against the sentence of seven years with hard labour, imposed at. the Auckland assizes, on May 17th., 1920. 011 the charge of indecent assault. The prisoner was not rep resent - ed In- counsel, and Mr W. G. MacGregor, K.C. (Solicitor-General) appeared for tin 1 Crown. After hearing the facts of the ease. Ilis Honour the Chief Justice said' lie was of opinion the Court had no jurisdiction to interfere with the sentence passed. The crime, continued His Honour, was one for which the prisoner might have got more than seven years; and. according to the existing law, the amendment, of section 12 of the 1910 Act, the Prison Board had power to consider the prisoner’s ease after 31 years. Tt was impossible for the court to place n- retrospective interpretation upon the \ el. and the appeal was dismissed
