WELLINGTON, June 2!) j Mr Justice Salinond delivered judg- J mont in tho Park case to-day. ’flic Minister of Education had in-, structcd an inquiry lo la- held on certain .statements alleged to have been made by Miss Park, a school teacher at Carterton, in connection willi her school duties. Plaintiff claimed the. regulation under which the Minister was proposing to suspend or cancel her certificate was • ultra vires, and if valid, the Minister! had shown such bias as disentitled him to exercise the discretion conferred on ' hint by the regulation. i Mr Justice Saltnnnd said: “If as 1 have held the regulation under which j the .Minister proposes to act is ultra ! vires and void, the action so proposed hv him would he not merely a nullity in respect to pin in t i If’s certificate, but would constitute an actionable injury to plaintiff. There will lie an injunction ; restraining the Minister from cancelling j or suspending the certificate."
