“There is a. phase of the question of expenditure upon public works to which I desire to call your Honour’s attention,” said Air T. O. Bishop, in addressing the Arbitration Court ‘ today. “If public works are undertaken to-dav at the existing high costs of material and labour, and at very high cost of money, there is no chance of these works ever becoming productive, and they will remain for all time a further burden on tbe taxpayer. It is safe to prophesy that in two years’ time the public will condemn this expenditure, although to-day they may be demanding it. Consider the example afforded by the Government bouses. They were built to satisfy a popular demand, and already tenants are clamouring for reduction of rents, which could only be given at the expense of the taxpayer. Tlie Prime Alinister sounded a note of warning in this connexion recently when speaking in regard to the five million loan just floated in London.”

APPEAL CASE. WELLINGTON, April 27

At the Court of Appeal, Mr .Myers, in continuation of his argument for th ■ Harbour Hoard, dealt with various sections of the Harbours Act, 1908, dealing with the powers of a harbour hoard to enter into contracts. This contract was not of the. type into which a harbour hoard was empowered by statute to enter. Section 57 of the Hai'bour« Act, made a “public tender” necessary in the case of any work undertaken hv a hoard. There had been no public tender in connection with the agreement entered into with Mr L.vsnar, and tlie scheme which he submitted to the Harbour Hoard.

The Court at this stage indicated that it desired to hear Mr Burna d (for Air Lysnar) oil the question of the necessity for a “public tender.” Air Burnard contended that section 57 of the Harbours Act did not make a “public tender” an essential in connection with Midi a scheme, ns tlm* submitted to the hoard hy Air Lysnar. The section was not mandatory, but was; i: erelv directory.

At this stage the Court adjourned until to-morrow, in order to give AD Burnard an opportunity of looking up a further authority. A RESERVED DECISION.

WELLINGTON, April 28. The Supreme Court reserved ifs decision on a motion for a now trial, arising out of the ease of Eliza Jane Gallagher versus Win AValker Rickncli. This was heard at Afastorton, occupying three days, and the jury awarded 6800 damages. The parties belonged to Greytown and the ground of the litigation was an alleged breach of covenant to repair, in a lease. The grounds whereon the defendant was asking for a new trial, are that the damages awarded were excessive, and that certain members of the jury had been guilty of misconduct in discussing the evidence with witnesses; that one witness for the plaintiff had been guilty of misconduct so as to affect the result of the trial, in that he informed the foreman and jurymen, that the flefendant made profits to the extent of £20,000 out of tlie lease from plaintiff to defendant.

j APPEAL COURT DECISION. WELLINGTON, April-28. The Court of Appeal delivered judgment this morning in tlie case of King v. Itedshaw, an application by Redshaw for a reduction of the sentence of nine months’ imprisonment imposed upon him at Napier, for misappropriation of certain funds of the Foresters Lodge. The judgment of the Court was delivered by Sir R . Stout who stated it was of opinion in view of the seriousness of tlie offence that the sentence was too j light. The Court therefore, in exercise ,of its discretion, increased.the sentence to 15 months imprisonment with hard labour. This ease is the first in which . the Court of Appeal has increased a sentence when an application was made , to it for a decrease. I; EA DA 11SSION A PPUOAT lON REFUSED. WELLINGTON, April 28. Law Society to strike F. J. Tipping off the roll of barristers and solicitors was that he be suspended for two years and ordered to pay £ls 15s costs.
