At the Westport Court on Uie Deputy-Registrar read the following decision of Mr Justice Adams in the case. Police '• Carmine. Mr A. Wilson appeared for the police, and Mr La wry, oil behalf of Cotterill and Lovell, appeared for Carmine;—Appeal from the decision of the Stipendiary Magistrate at "Westport dismissing an information charging the respondent with a breach of Sec. 206 (e) of the Licensing Act, 1908, by supplying intoxicating liquor to Ernest Morton and Robert McGill at a time when, they were not entitled lawfully to be supplied with liquor. The case stated that Morton and McGill visited the Tramway Hotel at Millerton between 10 p.in. and 10.30 p.m. on 26th December last, and that after some conversation about the races, the respondent, who was the baiman employed at the hotel, took the two men into the bar and supplied them with intoxicating liquor. The Magistrate considered himself bound to accept the respondent’s evidence that the liquor was supplied hv way of gift. The question to be decided in this appeal is whether that decision is right in law. In my opinion the decision was erroneous and the respondent ought to have been convicted. The appeal is allowed and the case is remitted to the Magistrate accordingly. The aiuellaui is allowed costs £lO 10s and disbursements to lie paid by the respondent.
