Tin? Praciiqiie Court has granted to Rev. Father Barry, the Administrator of tin* Roman Catholic Arch-Diocese of Melbourne a rule nisi, calling upon the Melbourne City Council to show cause why its present By-law regarding tile street processions should not

be quashed. ■ The application arose out of the prosecution by the City Council of some of the participants in the recent St Patrick’s Ba v ‘procession.

He held, without hesitation, that there should be a new trial. Xo other avenue of appeal is now open to Ross.
