PILLAGE' OF CARGO. I ' LI A EH. (IT Y OF SHIPOWNERS. g < DUNEDIN, March 3. A mercantile case of more than a little interest came before Mr Justice Sim to-day. The plaintiff was the firm of Herbert Haynes and Co., for whom Mr Solomon K. 0., and Mr Brasch. appeared. The defendant was the New | Zealand Shipping Company. Mr Solomon said it was a friendly action brought to obtain the construction of the Court as to a clause*in bills of lading- The clause involved was that which limits the liability of a shipping company in the case of loss or damage to .£lO per cubic loot for measurement goods. The question was as to what that clause means. There were three possibilities. It might be £lO per cubic foot of the case in which the goods are packed, or £lO per ! cubic foot of the package in which me goods are packed inside the case or £lO per cubic foot of the apace actually occupied by the goods in such ■ second package if there he one. The plaintiff claimed that the first of these constructions was the proper one. The shipping company contended for the third of the three constructions. His Honour reserved his decision.
