At the .Magistrate's Court to-day, .Maurice lluckley and l’ercival fowler wore charged with trick Hying, namely nose-diving, over Timarii and the Hying altitude being dangerous to the ]>ublic. The evidence of the prosecution was to the effect that the machine was observed Hying over Caroline Hay and nose-diving, and over the town lorty feet above speciiied buildings. The defence was a complete denial, and endeavoured to show the impossibility of gauging the height and location ol the aeroplane, and the importance ol what constituted a nosedive. 'I bey contended that the machine made abrupt turns in endeavouring to see the possibilities of the Hay as a landing spot. Decision was reserved.
