Ho was l'earrested recently in Auckland. Counsel asked for probation in view of prisoner’s youth and previous good conduct. Ilis Honour said the circumstaiieu of the offence was serious end sentenced the prisoner to five years’ reformative) treatment. FULL COURT APPEAL. WELLINGTON, Oct. 3. Tho Full Court is hearing argument in the case, of G. E. Anson of Wellington, medical practitioner, against the Commissioner of Taxes. Ihe case stilted by the Commissioner was that tho nppralaiit was for several years the owner of a sheep station near Hunterville. In making returns of income, be adopted a standard value for his stock. In Wls this standard of value was £3.117 and in PRO £3,776. In 101 f) the ap|>ellniit sold bis stock for £3,0.)0. The appellant claimed that the difference between tho amount the stock realised on sale and the standard value was merely the increment of capital brought about l»v the gradual improvement of the stock by careful breeding, and was not assessable for income tax. The Commissioner claimed that the sum was assessable.
Mr Cooke for appellant, contended that the facts showed: that at no time did the appellant carry on the business of dealing in sheep or cattle, therefore ativ appreciation in value of stock was mi accretion to capital, and was not liable to income tax.
