Mr MacGregor for appellant contended tlial the judgment of the Chief Justice was wrong, on the following grounds first, because the determination of the Secretary to allow officers other than respondent a larger increment. ' was not a determination of a superior officers relative to respondent's salary or promtion; second, because the amount of special increment was entirely in the discretion of the Secretary himself. There was no other method by which the appellant tribunal could fix the amount of any such increment; third, on account of delay, expense and hardship, which the view of the Chief Justice would involve; fourth, because the question involved relative to the grade of salary of an officer were confined entirely to the list of officers as provided by the Post and Telegraph Act.
