E. ; Teichclmann (Mr Park) claim for £25 j 7s 6d commission on sale of a Buick . motor car. ( Ebenezer Teichelmann’s evidence continued : He was not aware of being asked by Mr Wagner for him to act as his agent. The car was a Buick. He had had it for about a year and it was in good order. , To Mr Joyce— Bought the ear for | about £570, before the rise in the price of cars. Had no knowledge of any . question of commission. Went away without the slightest idea of having done any business that night. Thought that Wagner was a probable buyei when witness took him for a trial lide. ! Told Air Perham that Wagner had no . j authority to offer the car for £450. ! William Jeffries deposed he was an auctioneer. Was present at the con- ! versation between Dr Teichelmann : about his motor car. Hoard tlie Doctor say he wanted £550. Mr Wagner re-; j plied that the price was ridiculous. ; Wagner asked if he would give a commission and the doctor replied he want- . ed £550 for it and the first who came ; could get it at that price. To Mr Joyce—Some weeks previously the doctor mentioned that the car would cost £650, and that he would take £IOO less. Dr Teichelmann did not mention commission in witness’ presence. Was sitting between Wagner • and the doctor at the time. Alexander J. King, deposed he was amotor engineer. He knew the doctor s Buick ear. It was in good order. Considered £550 was a fair price at the time. . . His Worship reserved his decision.
