A WILL

FINDING OF THE COCUT

[UY TELEGRAPH—PER PRESS ASSOCIATION’]

AUCKLAND, April 9 Judgment was given in the will case where Alice Vera Goodwin, a widow of Greonlane, and Henry Cotterell, solicitor of Christchurch were the plaintills, and Lila Ethel and Margaret Goodwin (infants!, and Lila Lettia Horne, a married woman of Cambridge were the defendants. Mrs Goodwin sought the administration of the estate of tier husband Erdington Goodwin, the will being contained in the military paybook of the deceased which had been lo .t, and in the alternative she and Cotterell claimed probate to them of the will and codictile before enlisting. Deceased possessed an estate of an estimated value of one hundred thousand. A will made in 1911 devised the estate in trust for the benefit of his wife and children. A codicil in July 1915, made a bequest of £SOO to a sister in law, and the residue to the wife absolutely On the battlefield deceased wrote to his wife that he had altered his will in his paybook leaving everything to her, but in the event of anything happening to him, she might not get the book. Among his effects was found a paybook which did not contain a will. Justice Stringer said the evidence was insufficient to support a paybook will. He therefore refused probate of the alleged lost will, and granted the alternative claim for probate of the will and codicil.
