CARGO BROACHING. LYTTELTON, December 2. At tlie Railway Appeal Board sitting at Auckland to-da.y, (important points respecting procedure were for- 1 inaily raised by Mr C. R. Bell, Advo- 1 cate for the Appellants, in an appli-’ cation to the Board to rule that where ’the Department sought to justify the promotion of members to supersede ah applicant, the service records of the members superseding should be produc- 1 ed as evidence. The application was vigorously opposed by Mr J. Mason, for the Department. Sir Bell further applied for a ruling that evidence as to the incidents occur-' ring after the date of an adverse decision should be inadmissible as evidence. , , After a retirement, the Board upheld Ijoth contentions, with a reservation that, respecting the reclassification of last year, which was only authorised bv an amending Act of November last, evidence should be admitted up to the date of the amending Act.
