Op May tyl'-i 19J7, aij qr.dcj: was made bw Judge Stringer under the Family Protection Afct 1908, in favour of plaiptiff, Fox i n respect to the estate of his lafe wife jsatwlla Fox, By the will, the testatrix (Isabella Fox) among other provisions, gave £SOO to her sister, Mrs Carson! By the above order the Judge postponed the payment of the £SOO until the death of the plaintiff Fox. I„ an affidavit Mrs Carson alleged that 37 years ago, her sister informed her that she had previously been married to another man, who had mn away. She had since' ascertained this man was still alive. She had not mentioned the fact to the Court at the first hearing, because sbe did not wish to' 'smirch her sister’s character. She subsequently brought the action 'against yfjiich was dismissed by Justice gji’m on various grounds, The present application is to the o ol ,rt of Appeal for special leave to appeal, the ordinary time for appealw having elapsed upon the ground that the order of May 6th., 1917, was made without jurisdiction, and that tho material justice of the ease demanded the matter to be re-opened.
