I The petition set out that the nart-es ■were married at (Rockhampton on March 24th., 1916. They were in the prohibited degrees of affinity as the J defendant was a sister of plaintiff’s r o- I ther. After the marriage they lived to- I gether at Rockhampton and Mt. Morgan J for 10 months. There was no 'ssne I of the marriage. At the time of the j marriage plaintiff was 21 and the dcfondant 26 years of age. The plaintiff, knew that lie was marrying his aunt hut he declined to give any reason for nm step he took. The judge made a deelaration of nullity, but roseivetl decision as to whether there should u , an order absolute or nisi.
