R, Bartholomew S.M., with on Sept, loth last, unlawfully permitting an instrument to be used on her with intent to procure a miscarriage. The case arose out of the fact that at the retrial in Wellington, of Haynes and Neylon, the accused who was the principal witness, refused to give evidence.
