A LEGAL POINT. HAWERA, Jan. 13. An interesting legal point was raised at the Magistrate's Court upon the application on behalf of a judgment oreditor for an order attaching moneys to the judgment debtor s credit inthe Post Office Savings Rank. Counsel said an interlocutory order had been served upon the postal authont.es but it was returned with a den.nl of the power of the’ Magistrate s Court to Lke an order against the department, „n the ground that the money depositPtl in a P.O. Bank was the property of the Crown ,nnd therefore the Magistrate’s Court had not jurisdiction to make an order. The Crown was represented, Magistrate Bailey who resorved"ilils decision,' expressed the opinion that if the law provided that the moneys could not be attached, it should he remedied as it was extremely unfair a debtor should be able to. evade a creditor by locking up his money m a Post Office Savings Bank.
