Two charges of having obtained LI)

and L 3 rom Terence Curno by false pretences were laid against Herbert IJpsham before Air Wilson SAL, at the Police Court. The false pretences alleged wore that accused had telegraphic communication with and from a well-known jockey, Jack O’Shea, respecting the winning chances of certain horses named respectively Pleasant .Mount and Beeswing, then duo to eoim pole at the Metropolitan trots at Christ church, and Gang Awa’ and Battle Array at the Canterbury Jockey Club’s race meeting at Uiecarton early this month.

Curno stated that he and accused arrived in Auckland this month, and as the result of statements made by ac-

cused respecting tips he had receive! from O’Shea, who, he said, was rifling at Christchurch, witness gave him ,C! to hack certain horses. He received in dividends, and later found out tlial O’Shea was not in the country when the meetings were held.

Police evidence went to show that O’Shea did not participate at either meeting. Accused said that lie had been a horse-owner, and was conseqently ‘‘well up” in racing matters. It was from O’Shea’s punter and not direct from the jockey Hint he got his tips, lie at first denied that Curno had given him money, bill later admitted it. The magistrate accepted Cimio’s version of the transaction, ami sentenced accused to three months’ imprisonment on each charge, I lie sentences to be concurrent. IJpsliam was further charged with being a military deserter. He was ordered to be banded over to the military authorities at the expiration of his term of imprisonment.
