MAGISTRATE’S COURT.

THURSDAY, JAN. 30th

(Before E. C. Levvey Esq., S-M.) ' PROHIBITION. An application was made for the issue of a prohibition order against a returned soldier, on the application of his sister. The application was granted.

SUNDAY CONCERT. Borough Inspector, (Mr. Park) v. Lilian Fitzsimmons, a charge of on 12th Jan. allowing the Westland Opera House to he used, for the purpose of a concert without the consent of the Borough Council authorities. Defendant pleaded not guilty. Mr Park said the charge was laid under the Municipal Corporations Act, sections 305 to 311, tvhicli forbid the holding of Sunday concerts without the consent of the municipal authorities. The Town Clerk spoke to the defendant and the holder of the concert, stating that they must not hold the concert without permission being given. Charles Gibbons (Borough Inspector) gave evidence that he warned dc Lissac against holding the concert. The concert was held. The building was not licensed at the time, the license expired on the 31st December. A. A. Andrewes (Town Clerk) gave evidence that.no permit was given to hold the concert on the 12th. A warning was given not to hold the concert, personally telling Mrs Fitzsimmons, and writing to that effect to de Lissac. To the Magistrate—lt would have been purely a matter of form to have renewed the license, prior to the holding of the concert; since then the issue of the license has been held over. The action had been brought beeaus the Council had been flouted, and to prevent repetition in the future. This was the case for the prosecution.

Mrs Fitzsimmons said she did not allow the concert to be held to flout the Council. She had taken the word of Mr de Lissac, who said lie had'the permission of the Mayor to hold the concert.

In answer to the Magistrate, ulio asked if the Council was pressing for a heavy penalty, Air. Park said they wanted this sort of thing stopped.

His Worship entered a conviction and inflicted a line of €5 and costs 7s, with counsel’s fee £1 Is Od. land dealers. o. Horton, application for a land deal’s license. —Granted.
