AFTERNOON SITTING. Tho Court resumed at 2, p.m. (Details of the morning sitting j on page 2.) j TOOHEY Y. FLEMING. | His Worship gave judgment in the j claim of Toohey v. Fleming. In the ! course of a lengthy judgment lie said that the Defendant said he did not go on ' professional business while the plaintiff I stated he had made a professional visit. It has been proved that the visit was : i n a professional capacity. That Dr. j Fleming did make a professional visit 1 to Otira hospital and to Mrs. Griffen The Matron was quite clear that a round of- visits was made. It was proved the weather was fine, thus corroborating the plaintiff’s evidence. Tho defendant’s statements were inaccurate and it was a pity that he should bare contested the action. Judgment would be given for the amount claimed £5, with witnesses expenses £5 2s 8d Court costs £1 135., Counsels fee £1 6s. a total of £l3 Is. Bd. CUSTODY OF CHILD.
A charge of assault, by Nora Stewart(Messrs Park and Murdoch) v. M. Stuart and 33. (Burger (Mr. Wells) arising out of a dispute over the custody of the child of plaintiff a dot of three years was heard at some length. The hearing was then adjourned to enable the parties to some to an agreement. In the afternoon, the case was further heard and then adjourned till next Court Day to allow of an arrangement come to for the return of the child next week to be carried jmo effect.
