Tile evidence o James Toohey was to the effect tha 1 Dr. Fleming phoned from Kumara t Hokitika stating that he had an ui gent call to Otira ana there wore n motor cars available asking him 1 ' bring his cycle and side car to Ki mara to take him to Otira. I his wr done. The defendant totally denic ® the facts stating that Toohey was ci deawouring to sell him the the eye and that! the trip ’ to Otira was trial run given by Toohey, The letter went into thei box aga and denied the aspect in toto. Uli mately on plaintiff’s application tl hearing was adjourned to next sittii r to enable plaintiff to supply corrob tive evidence.
