AN INTERESTS CASE.
APPEAL COURT. [PKR PRESS ASSOCIATION. —COPYRIGHT.] WELLINGTON, September 28. The Court of Appeal this morning heard argument in the ease of Robin versus the Union Steamship Company. The ease raised an interesting and important point, whether in an action against nn employer hv a wife or a mother dependent on the deceased servant who met his death through negligence of a fellow servant, damages are unlimited. or whether damages are limited to £SOO. The question turns upon the construction of Section 02 of the Workers Compensation Act, 1008, an amended by Section 13 of the Amending Act of lfHl. The claim in the action is for £IOOO hy plaintiff, as daughter of the. late John Robin, who died as a result of an accident on the steamer, Wannka on 2nd. April, 1017. Dependant issued a summons to amend the claim hy reducing it to £SOO. Mr. Justice TTosking dismissed tho summons and defendant now seeks to have that decision reviewed hy the court.
