MINING APPEAL.
The following reserved decision of Mr Justice Si mm in the appeal ease, Lake Iloekstdtter Co. a - . Donnellan Bros was read at the Courthouse, Greymoutli, yesterday: —His honour held that the circumstances in this case were not such as to justify the imposition of a fine in lieu of forfeiture, and tho judgment of the Warden’s Couro is varied* accordingly by decreeing a forfeiture as asked for in the notice of appeal, with costs against Donneuan Bros. of 20 guineas and ' disbrusements and witnesses’ expenses to bo fixed by the Registrar. His Honor added that apparently the only effect will be the loss of priority to Donneilan Bros., and that they could apply for a fresh right to it. There is nothing to justify the view that there will not he plenty of i-ater in Lake Hockstetter to supply the appellant’s BO heads, and all the water to which Donnellan Bros, will be entitled.
