The Full Court gave its reasons this morning for its opinion expressed on Friday last, that both the Bay of Islands and Taumaruiiui election petitions were in time. In the first mentioned case the Court held that the time within which the petition must be presented, namely 28 days, ran from the amended declaration, published after the recount by order of the Magistrate's Court. It held that the law as now existing was different from that upon which the Wnirarapa case, in which it was held that the time ran from the endorsement oi the writ, was decided, and that that case wan now of no authority. It further held that the words of section 15)0" of the 7x>-is-lafive Act, 1908, show that the time must run from the declaration made in pursuance of section 1:1 nf the Act of 1900. which is a declaration in form ■No. 22 of the schedule to the Act of 1!MM). The. decision on the latter point decider the question of time in favour of the petitioner. In the Tauinariiimi case tlie Court intimated that it would givo its judgment on the question as to wTfethor the roll was conclusive to-morrow. THE KING v. MeLROD. Jn the case Rex. v.
