Tn answer to the contention of Council tor the plaintiffs, thai the information had not heen laid within thi'ee years after the alleged offeree took place, the Solicitor - General contended, first, that the alleged charge was not the doing of an .act. hut the evading of taxation by that act : that the doing of the act was not the completion of the offence, and that the offence was complete onlv when the .taxation was evaded, which might he many months later. Thi'it being so. counsel conitinued. even if plaintiffs argument was ri'iht. the '.Wairistrate had not erroneouslv dr.'-ided a.nv point, of la.w collateral to the merits, and prohibition would not be :>.t this stage.
