Civil Servant, and wife seek to recover from Dr. Ernest Rawson £7bo, as damages for bodily in, lilies sustained by Mrs Ihe case is la sequel to ah accident which took place at the Heretaunga links, Hntt Valley. Defendant, in swinging his club, struck Mrs Leckie on the face, breaking her nose and injuring the frontal base of her skull, also severing the olfactory nerve, as a result of which she lost all sense of taste and smell. Ihe defence was that Mrs Leckie had no right to be where she was; that defendant was not guilty of any negligence, and that the accident was caused through Mrs Leckie breaking a • recognised custom by passing over the tee at the back of the plaver without giving any warning of her approach.
