A case of unusual interest arising out of a speculation in the purchase of a trotting horse by a Hamilton motor salesman, came before Mr. Justice Herdman in the Supreme Court, when Aii'red William Ebbett took proceedings against Robert Young, ot Matamata, to recover £460 general and £lOO special damages, on the grounds of alleged fraudulent misrepresentation, and, alternatively, alleged breach of warranty on the sale ot a trotting horse called Bingen Bell. The evidence of trainers on a promise given to buy the horse was conflicting, while apparently there was a misunderstanding as to the price t originally paid for tiie horse in the ■ on nations by Ebbett for purchase. Judgment was given for the defeni dallt.
