BUS COLLISION

NEGLIGENCE IN OVERTAKING. (Per Press Association). Wellington, Dec. 6. Arising out of a collision on the Hutt road between two ’buses, the Eastbourne Borough Council, as operators of one bus, claimed damages of £26 against A. L. Cotterill, the operator of the other. The evidence showed that the defendant’s driver pulled out from behind a lorry and proceeded to pass as the other bus was approaching. The defence was that the plaintiff’s driver should have pulled out to the left to give more room and not hugged the bitumen, which he was alleged to have done. The Magistrate held that the defendant’s driver showed negligence in attempting to pass the lorry when the bus was approaching and found for tire plaintiffs because, in the circumstances existing, it had not been shown that the plaintiff could, by the exercise of reasonable care and skill, have avoided the defendant’s wheel.
