It has been supposed in some quarters that hotels could open on Monday. December 26. which this year is being observed as a public holiday in lien of Christmas Dav. This is incorrect (says the Timaru Herald) The Public Holidays Act, 1910, has no reference to the closing of hotels, but according to section 189 and 190 of the Licensing Act, ISOS, it is an offence for a licensee to sell intoxicating liquor on his licensed premises on a Monday observed as Christmas Dav in circumstances such as occur this year. This statutory provision is borne out by an appeal case. Dew v. Ryan nt Westport in 1911, when it was held that where Christmas Day falls on a Sunday and is by virtue of the Public Holidays Act, 1910, solemnised on the next succeeding Monday, it is an offence under the provisions of section 18!) and 190 of the Licensing Act, 1908. for a licensee to sell intoxicating liquor in his licensed premises on (he said Monday.
