THE Hawke's Bay Times. Nullius addictus jurare in verba magistri TUESDAY, 24th NOVEMBER, 1874.

In the Court of Appeal, Wellington, in the case of Cashmore v. Maney, the decision has been reserved. Sir Donald M'Lean, Mr Davis (secretary), and Colonel St. John left for Auckland per s.s. Southern Cross on Saturday. Yesterday was oppressively warm, with wind and clouds of dust. After sunset a brief but heavy shower descended, clearing the atmosphere considerably. Mr Neilsen, the Norwegian missionary, is now in Napier, where he .intends remaining for a fortnight. He conducted services on Sunday in the Oddfellows' Hall.

By the Southern Cross on Monday, a locomotive for the Napier and Pakipaki railway arrived. On Tuesday it was fixed upon two low carts to bo conveyed to town ; but before it had been taken many yards, one of the drays broke down, the axle having given way under the weight. Yesterday it was placed in a wagon, and successfully conveyed to town. The Colonial Architect lately paid a visit to Napier, partly in reference to the site for the new Post Office. It has been stated that to avoid encroaching on the present road, the building was to be erected some little space further back, so as to overlap Browningstreet, a position which would not be quite satisfactory, though not so bad as the one originally intended. Operations on the building are still suspended.

A meeting was held on Friday, in the Council Chamber, Mr J. Buchanan in the chair, to consider the present position of the Jockey Club in this Province. It was stated that there was about £3OO to the credit of the old club, which was virtually defunct, and a new club was formed—entrance fed one guinea, and annual subscription two guineas. The meeting was then adjourned to the 30th inst. On Saturday an individual charged with being unlawfully on the premises of Mr Witty, was dismissed wiih a caution. Yesterday an old offender was ordered to be locked up for fortyeight hours for drunkenness and having no visible means of support. Seraphine Hansen applied for an order fori maintenance from her husband, who had deserted her without reasonable cause, and gone, she believed, to Wellington, hhc complained that her husband had ill-used her, threatened her with a pistol, turned her out of doors, and stopped her credit. A summons was granted. In the Resident Magistrate's Court on Friday, one drunkard was fined ss. There were two debt cases. In one of these a storekeeper named Grant sued for £5 15s. Defendant did not dispute the debt, but said that he had a wife and large family, nearly all of whom had been ill for some time. He was only earning 30s a week as a laborer in a timber yard, not being strong enough for quarry-work, and out of this had to pay 14s per week house-rent. His business was that of a dyer; he was a skilled hand, and could soon dear himself if ho could only get the requisite plant, as he had promise of plenty of work. All he required to make a start was a large copper kettle; the plaintiff had refused to trust him with one, and he had not a friend in the place to help him.—Plaintiff did not dispute any part of this statement, but said that defendant was very well able to pay 5s per week. The Magistrate gave judgment for amount claimed, with costs, and allowed time for payment. He further said that he would make inquiries, and if satisfied with the correctness of the defendant's statement, would endeavor to have him put in the way of carrying on his trade.
