Hawke's Bay Times. Nullius addictus jurare in verba magistri. TUESDAY, JULY 16, 1872.
In the Resident Magistrates Court yesterday, at 4 p in., further evidence was taken in support of the charge of larceny against Samuel Sykes. Timothy Sullivan, driver of Cobb's coach, deposed that on the Bth inst. he saw the prisoner get three or four drinks at the Clive Hotel, and gel two or three notes in change. He did not see whether a cheque was given in payment or not. —The prisoner was committed for trial at the next sittings of the Supreme Court. The body of a man, name unknown, was found early yesterday morning in the Waifangi Creek The circumstances will he be<t gathered from the evidence of Mr Louis Stevens at the inquest, which was held by Dr Hitchings at 4 p.m He deposed :—" lam a gardener, residing at Wailangi. About 8 o'clock this morning I was told that the body of a man had been found in the Waitangi creek. I immediately went to the bridge, and I saw the body about 25 yards from the bridge ; the head was above the water, and appeared in an almost upright position. Malcolm Walker and Charles Ay vex went with me. Rabone told me he had seen the body on the opposite side of the bridge, and while he was away the body had drifted to where I saw it, a distance of thirty yards. We did not interfere with the body until Constable Neagle's arrival. We all assisted to get the body out. I did not recognize the person. I should take deceased to be about 40 years of age, 5 feet 6 inches in height, dark brown hair, rather stout built, a short stubby beard (about a week's growth), rather long whiskers, which went under his chin. All his clothes were on, except one boot. His hat, which wdti dry, was fb'ind just the bridge on the land. Michael Baldwin and George Stevens had seen the body an hour before, but had not interfered with it. 1 should not think he had been dead more than twenty four hours. I did not notice any bruises or signs of ill'treatment, but his right eye was disfigured, from what .1 should think to be the effects of small fish or eels; also, the under lip. In lifting him out of the water, blood oozed from the right, eye. He was afterwards removed to Mr Jeffares' Hotel." The jury returned a verdict of " Found drowned; name unknown,'*
There were no cases in the Resident Magistrate's Court this morning. In the District Court there was one case set down for hearing, but it did not come off. The English Mail via Suez may be expected to arrive here to-morrow, per Keera, from Wellington. The southern mails, &c, taken on to Auckland per Nevada/ arrived here by the Star of the South this morning. The General Assembly of New Zea* land was 10 be opened at Wellington this afternoon. Mr David Scannell has been appointed "Resident Magistrate forTaupo, with jurisdiction to X2O, during the the absence of Mr Locke. The New Zealand Gazette rexokes the postal regulations in reference to bankers' parcels from the Ist August next.
