Hawke's Bay Times. Nullius addictus j urare in verba magistri. TUESDAY, MAY 21, 1872.
We are indebted to Mr C. E, Keehle, purser' of the s.s. Keera, for the prompt delivery of our Auckland hies and for other favors. It is stated on good authority that the General Assembly will be called together for the despatch of business on or about the 15th July. In the Resident Magistrate's Court tliis morning the following cases were heard.—Russell v. I)enipsey.—Judgment summons for ,£4 4s 9d —Defendant gave as his reason for not settling the account, that he had a small contra account against the plaintiff.—Order for immediate payment, with costs. Routledge v. Collins. —Adjourned to Thursday, Mr Stedman being ill Higgiris Brothers v. Collins.— Claim of <£4 3s 9d.—Judgment confessed for amount claimed and 9s costs. Morrison v. Power.—Claim of k.% 5* for a watch chain and for work done. Plaintiff said he had not seen the defendant for seven years, and was ignorant of his address, so that the account had not been rendered during that period Mr Lee appeared for the defendant,, who, being sworn, stated positively that he paid the money before leaving Napier —Mr Sealy said that when there •was a doubt in the case, as at present, it was impossible to decide with certainty as to facts; but he would give i\,Q defendant the benefit of the doubt.
Judgment for defendant. Neagle v, S. Oatham. Claim of £3 5s lid. Defendant disputed items amounting altogether to £2 Is 6J, incurred by his brother. —Plaintiff said that the defendant had distinctly agreed to pay his brother's account, and had paid money on account of a bill in which the items now disputed were included.—Judgment for amount of claim and 9s co«ts. Ron Hedge v. Robottom.—Plaintiff, as President of the N.V.A. Band, claimed £B, or the return of an instrument, the property of the band, unlawfully retained by the defendant. —Defendant admitted that the instrument band property, aud expressed his willingness to return it when he should be paid <£3, his own earnings, and placed to his credit in the books of the Band. (The particulars of this fund were stated ; but we have already given them in the case RoutJedge v. Collins) —liis Worship said that even if the money was due, it did not give the defendant the right to retain the instrument. He would give no opinion as to the money earned, as another case of the same kind was pending.—lnstrument to be returned, with costs, 13s.
A malicious trick has been played on Mr T. Reynolds by some peison at prosent unknown. The pole of the mailcoach suddenly broke between Wahaparataand Havelock yesterday morning, and on examination it was found that. it had been cut nearly through, apparently with a chisel. The cut on the upper part of the >haft was so narrow as to have escaped observation, the new surface having been smeared over; but the cut on the under side vas wide and deep. The injury was quickly repaired, and the journey resumed. From our advertizing columns it will be seen that Mr Reynolds offer* a reward of £2O for the discovery 0.-' the perpetrators. Another spiteful trick was played on Mr Reynold* on Monday morning. His stable was entered, the tethers of the horses cut, and the animals turned adrift into the While road It is to be hoped that the offender will be disco vered, and dealt with according to his deserts.
From our hies to hand to day, we learn that the progress of the telegraph works between Giahamstown and Coromandel has been stopped by obstructive ness on the part of the natives.
The following are some of the latest Auckland sharcmarket quotations, being up to the evening of the 1 7th insf. : Caledonian, .£l9 ; Green Harp, ,£7 ; Thames, £5 g« 6d ; Moanatairi, £5 ; Bismarck, M 10s; Tokatea, £'s 15s; All Nations £3 15s; Golconda, £2 7s 6d; Central Italy, jgl 15s; Siege of Pari-, 18s; Roval Oak, 14s; Excelsior, 14s; Pacific, "l3s; Windsor Castle, lis; Coromandel Beach, 14s. The barque Chattanooga, for New Yoik, left Auckland on the 17th inst., and the ship Naomi was to have sai'ed from Russell (Bay of Islands) on the same day, bound for New Bedimd. The cargoes of these vessels consisted of sperm oil, phormiura, tow, kauri gum, &c, valued in all at .£56,917. Referring to recent Southern telegrams, to the effect that Mr Brogden, having settled all difficulties with the Government, would, in a few days, send in specific tenders for the various railways, the New Zealand Herald says : " As far as we are concerned this can not happen too soon. The delay with the Waikato railway has been indeed grievous, and the waste of money thereon painful to witness." The Waikato Times tells an amusing story of a case of " pounding." It says : . " The following took place in one of the townships in the Waikato :—Two individuals found some cattle on their land, and determined to impound them. The cattle were rather wild, and they drove an old cow as a decoy. They succeeded in getting the cattle into the pound, and feeling rather fatigued with their exertions, they adjourned to a public house to refresh the inner man, leaving the co-v outside. The pound keeper came along during the time they were imbibing, and impounded their old cow. The termination of the affair was the ' pounding ' of the ponndkeeper. This is ihe most complete case of 5 pounding ' we have been called upon ' ta record"
